Palliative Care and Legal Psychology – Interfaces, Challenges, and Possibilities for Action

Abstract

This chapter presents a narrative review of the interfaces between palliative care and Legal Psychology in the Brazilian context, analyzing how ethical, legal, and psychological aspects are articulated in the care of terminally ill patients. Based on recent national literature, official documents, and guidelines from the Ministry of Health, the importance of autonomy, advance directives, assessment of legal capacity, mediation of family conflicts, and protection of vulnerable individuals is discussed. It highlights that the end of life involves complex decisions that go beyond the clinical scope, requiring interdisciplinary action to guarantee dignity, emotional security, and respect for the patient's fundamental rights. Legal Psychology emerges as an essential field to support multidisciplinary teams, guide decision-making, prevent unnecessary litigation, and identify situations of negligence or violence. The chapter also points to structural and educational challenges for the consolidation of palliative care in Brazil, emphasizing the need for strengthened public policies and greater integration between health, justice, and psychology. It concludes that this interface contributes to humanized, ethical, and legally sound practices.

  • SIMONE UBINSKI , FISMA - FACULDADE INTEGRADA DE SANTA MARIA RS

    Simone Ubinski is a Psychology graduate (expected completion in December 2025) and a postgraduate student in Neuropsychology. She works as a scholar of Legal Psychology, with a special interest in criminal behavioral analysis, an area in which she is developing her undergraduate thesis. She also holds degrees in Spanish Language and Literature and in International Trade.

  • Letícia Bonfada, FISMA - FACULDADE INTEGRADA DE SANTA MARIA RS

    Undergraduate student in Psychology at the Faculdade Integrada de Santa Maria and specializing in Oncology, Hematology, and Palliative Care at FISMA. Member of the Palliative Care League at the Federal University of Santa Maria and the Academic League of Hospital Psychology and Public Health - UNAERP, where she seeks improvement and knowledge in the area, as well as significant involvement with interventions alongside the team. Participates in the Study and Scientific Initiation Group (FISMA) - Integrality of Care for People with Chronic Illness, where she seeks to develop skills and competencies in understanding the needs of people with chronic diseases. Works with the Study and Research Group in Nursing and Health (GEPES) (UFSM), contributing to studies and scientific productions on Palliative Care and multidisciplinarity. She has an interest in Psycho-oncology, Health Psychology, and Scientific Research, with an emphasis on the clinical and hospital area and on topics such as hematological cancer, palliative care, and the processes of death and grief.
